International Review of Law publishes a special issue on Sovereign Wealth Funds

05 March 2015

Online academic publishing platform of Bloomsbury Qatar Foundation Journals to focus on legal and regulatory issues of Sovereign Wealth Funds (SWFs).

Doha, Qatar, 5 March 2015: International Review of Law Journal (IRL), has published a special issue on Sovereign Wealth Funds dedicated to the exploration of emerging global legal sovereign wealth funds (SWFs).  The IRL journal, published on the QScience.com online publishing platform of Bloomsbury Qatar Foundation Journals (BQFJ), is accessible to all with free to read articles.

With Sovereign Wealth Funds increasingly demonstrating their global appeal, the need to understand legal and regulatory issues has been the stimulus to publish the document.

IRL SWF investments are now being felt far and wide in virtually all international investment markets as well as through SWFs’ ambitious private investments in finance, real estate, agriculture, energy exploration, transportation, infrastructure development and technology. The IRL is a double-blind peer-reviewed,  international law journal that publishes contemporary legal scholarship in international law. It is also open to doctrinal, context based, reformative or comparative work, in all fields of law and the authors retain copyright in their work.

The online publishing of the special issue  supports the mission of Qatar Foundation for Education, Science and Community Development (QF) in its quest to enhance transfer knowledge. BQFJ is a  collaboration between Qatar Foundation and Bloomsbury Publishing that fosters scholarly and research communication, with QScience.com being one such unique research environment.

Several legal questions that are challenging, intricate and novel have arisen with respect to SWF investments. This special issue brings together eminent scholars who tackle these complexities and offer insightful analysis and suggestions.

The cutting edge topics in this issue include: the connection and interplay between SWFs and global financial institutions with respect to anti-corruption measures and economic policy in developing states; SWFs as ‘investors’ in international trade and the scope and substance of procedural rights in the framework of the World Trade Organisation and General Agreement on Trade in Services;  the definition of ‘investor’ and the identity of SWFs and State Owned Enterprises in the context of global trade and international investment treaties; SWFs and restrictions on foreign investment, sovereign immunity, taxation and corporate social responsibility; Committee on Foreign Investments in the United States review of SWF transactions in light of recent case developments in the United States focusing on ‘due process’ considerations; and a discussion of incipient SWF shareholder activism, the ensuing impact on United States securities law and proposals for amending the current regulatory structure.

Professor Joel Slawotsky, the journal issue’s Guest Editor of the International Review of Law Special Issue: Emerging governance issues of sovereign wealth funds, said: “It has been a distinct pleasure working with QScience, IRL and our distinguished authors. This issue will serve as a vibrant platform for further scholarship and will also advance the discourse in both the private and government sectors.”

Dr Christopher Leonard, Head of Academic & Journals Publishing of QScience.com said: “Some of the wealthiest nations on Earth are ensuring their future financial security through the means of sovereign wealth funds, and we are delighted to offer this latest research into SWFs for free, for all to read on QScience.com.”

The journal covers insightful issues concerning financial security, trade and investment, which constitute an integral part of Qatar Foundation’s strategic goal to support the Qatar National Vision 2030 of transforming Qatar from a hydrocarbon to knowledge-based economy and its key pillars including economic diversification.
