Abstract

هدفت الدراسة إلى التعرف على تأثير ظاهرة الفساد الإداري على حقوق الإنسان والتنمية البشرية في الجزائر، مع إشارة لأهم الوسائل القانونية لمكافحته، حيث يعتبر الفساد من الظواهر الخطيرة التي تواجه جميع دول العالم، ولها تأثير سلبي على التنمية الشاملة والاستقرار السياسي والاجتماعي فالفساد يشوه البنية الاجتماعية وله آثار كبيرة على الدولة في كل قطاعاتها. وتوصلت الدراسة إلى جملة من النتائج أهمها أنه رغم مجهودات الجزائر وإجراءاتها التشريعية والإصلاحية المصاحبة لمكافحة الفساد وخاصة إصدار القانون رقم (06-01) المتعلق بالوقاية من الفساد ومكافحته (الذي يعتبر تتويجا لإجراءات مطابقة القانون الجزائري مع مضمون اتفاقية الأمم المتحدة التي صادقت عليها الجزائر في سنة 2004)، لم ترقى مؤشرات الحكم الراشد في الجزائر إلى الوضع الجيد وتعود الأسباب في ذلك لاستمرار تفشي الفساد ويعود السبب بالدرجة الأولى إلى عدم الالتزام الكلي بتطبيق قوانين وتشريعات مكافحة الفساد. وعليه أوصت الدراسة بأن فاعلية التشريعات والإصلاحات القانونية لمكافحة الفساد والوقاية منه تتطلب البيئة الملائمة بأبعادها التشريعية والرقابية والقانونية والإعلامية كما لا يمكن تجاهل دور المؤسسات التربوية في تحجيم الفساد بواسطة زرع القيم الفاضلة التي ترفض الفساد بكل صوره، ويبقى النظام السياسي الديمقراطي هو الكفيل بالقضاء تدريجيا على الفساد بمشاركة كل الأطراف الفاعلة في هذا المجال، بوجود دولة القانون والحكم الراشد.

This study aimes to identify the impact of Administrative Corruption on Human Rights and Human Development in Algeria, with reference to the most important legal means to combat it. Corruption is facing all countries and has a negative impact on the global development, and political and social stability. Corruption deforms social structures and has great effects on the state in all its sectors. The study found a number of results, the most important of which is that despite Algeria's efforts and its legislative and reform measures to combat corruption, in particular the promulgation of Law No. 06-01 on the Prevention and Combating of Corruption(which is the culmination of procedures for the conformity of Algerian law with the contents of the UN Convention ratified by Algeria in 2004), the good governance indicators fell short of reaching the required status. This is due to spread of corruption and lack of commitment to the implementation of the anti-corruption laws.

This study recommends that the effectiveness of legislations and legal reforms to combat and prevent corruption requires an appropriate environment encompassing legislative, regulatory, legal and media dimensions. Moreover, the educational institutions have a role in curbing corruption by instilling values that reject all forms of corruption. It remains the democratic political system that can gradually eliminate corruption with the participation of all actors in this area, with the state of law and governance.
