%0 Journal Article %A شهيدة قادة, أ.د. %T التجربة الجزائرية لمكافحة الفساد و مفارقاتها: إطار قانوني و مؤسساتي طموح يفتقد لآليات إنفاذه %D 2019 %J Rule of Law and Anti-Corruption Center Journal, %V 2019 %N 1 %@ 2617-2763 %C 5 %R https://doi.org/10.5339/rolacc.2019.5 %K مكافحة الفساد %K المسار الإصلاحي %K الاستراتيجية الوطنية %K anti-corruption %K illusion empire %K corrective action %K institutional framework %K Corruption %K national strategy %K الإطار المؤسساتي %K الفساد %K امبراطورية السراب %I Hamad bin Khalifa University Press (HBKU Press), %X ملخص: ظاهرة الفساد توصف اليوم بأّنها أكبر التّحدّيات والعقبات الحائلة دون تنمية المجتمعات ورقيّها، لما تمثلهُ من افتئات خطير على منظومة حقوق الانسان وهدر بالغ للمواردِ المادّية والمالية للدّول. والجزائر حديثة العهد باللّبرلة والاقتصاد الحرّ، لم تكد تنتهِ حربها الضّروس ضدّ الارهاب، حتى وجدت نفسها كرها في مواجهة آفة الفساد، شديدة الوقع والانتشار، مقننة ومنتظمة، تنخر في جسم المنظومة الاجتماعية برمّتها. وقد آثرت السلطات العمومية في الجزائر بدء معركتها مع الفساد بالتّحالف مع المجتمع الدّولي (مصادقتها على الاتفاقية الدّولية لمكافحة الفساد لسنة 2004) لتسنّ بعد ذلك القانون 01 لسنة 2006 المتعلق بالوقاية من الفساد ومكافحته، وتتبع ذلك بإصلاحات لافتة لقانون الاجراءات الجزائية، والصفقات العمومية، ناهيك عن استحداث إطار مؤسساتي واعٍ للمراقبة والتّحرّي عن جرائم الفساد. ومن المفارقات الغريبة أنّ هذه المساعي لم تتمخّض إلا عنْ واقعٍ مُغاير مؤدَّاه زيادة وتيرة الفساد واتساع رقعته، وتذَيّل الجزائر المراتب الأخيرة في مؤشرات الفساد العالمي، عام 2018 (المرتبة 112 من 180 دولة). وهو ما دفعنا إلى محاولة الإجابة عن سؤال جوهري يتعلّقُ بِمصدر هذا التّفاوت بين ثورة النّصوصِ والحصيلة العملية المتدنّية لمكافحة الفساد في الجزائر، بالتّركيز على القدر الذي يمكن أن يرتبهُ الإطار القانوني والمؤسساتي من فعالية وإنفاذ، وذلكَ من خلال رصد وتشريح مفارقة التّفاوت (المحور الأوّل) ثمّ البحث عن آليات الإصلاح وتصحيح هذا التراوح المُقلق (المحور الثاني). The phenomenon of corruption is described today as the greatest challenges and obstacles to the development of societies, because it threatens the human rights system and wastes material and financial resources of countries. Algeria, a country that has been recently introduced to liberalism and free economy, was confronted with anti-corruption complications as soon as it ended its viscous war against terrorism. The Algerian public authorities have chosen to start their fight against corruption in alliance with the international community (ratified by the International Convention against Corruption of 2004) and subsequently enacted Law No. 10 of 2006 on the Prevention and Control of Corruption, followed by landmark reforms of the Code of Criminal Procedure, as well as the development of a conscious institutional framework for monitoring and investigating corruption crimes. It is ironic that these efforts have only resulted in a different reality of increased corruption. Algeria ranks last in global corruption indicators in 2018 (112th out of 180 countries). This led us to try to answer a fundamental question concerning the source of this discrepancy between the text revolutionary development and the low practical outcome of the fight against corruption in Algeria, this will be achieved through focusing on the extent to which the legal and institutional framework can be effective and executed; first by monitoring and dissecting the paradox, second through searching for reform and ratification mechanisms to fix the disturbing paradox range. %U https://www.qscience.com/content/journals/10.5339/rolacc.2019.5
